1. AGREEMENT TO TERMS

These Terms of Service ("Terms") govern your access to and use of Canopy Report ("Canopy Report," "we," "us," or "our"), including our website at https://canopyreport.app and the report-generation application (collectively, the "Services"). By creating an account or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. ELIGIBILITY AND ACCOUNT REGISTRATION

You must be at least 18 years old to use the Services. By creating an account, you represent that:

  • You are a qualified professional with the training, certification, and/or licensure necessary to perform tree risk assessments in your jurisdiction (such as ISA certification), and that you will exercise independent professional judgment in reviewing and finalizing any report generated using the Services.
  • All information you provide during registration is accurate and complete, and you will keep it up to date.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at admin@canopyreport.app if you suspect unauthorized use of your account.

3. DESCRIPTION OF SERVICE

Canopy Report is a software tool that helps consulting arborists structure field observations into Level 2 Basic Tree Risk Assessment reports. The Services calculate risk ratings using fixed, deterministic methodology matrices based on the data you provide, generate a branded PDF report, and offer optional AI-assisted drafting of narrative sections that you review and approve before use.

Canopy Report is a software tool, not an arborist service provider. We do not perform tree inspections, tree risk assessments, or render any professional arborist opinion. We provide software that assists you, a qualified professional, in preparing your own professional work product.

4. PROFESSIONAL RESPONSIBILITY

This section is important — please read it carefully.

  • You are solely responsible for the accuracy of all field observations, measurements, photographs, and other data you enter into the Services. We do not independently verify any input you provide.
  • Risk ratings are calculated by applying fixed ISA methodology matrices to the inputs you supply. The Services do not exercise judgment, discretion, or professional expertise in producing these ratings — they are a mechanical calculation based entirely on your inputs.
  • Residual risk determinations, reinspection intervals, and all final professional conclusions are yours alone to make. The Services never generate or suggest these values; you must set them based on your own professional judgment.
  • Any AI-assisted narrative text (Discussion, Conclusion, and Recommendations sections) is a drafting aid only. It is always optional and always editable. You must independently review, revise as needed, and approve all such content before it is included in any report delivered to a client. You are solely responsible for the accuracy, completeness, and appropriateness of any report you deliver, regardless of which sections were AI-assisted.
  • Canopy Report is not a substitute for your professional certification, licensure, insurance, continuing education, or independent judgment. Nothing in the Services constitutes professional advice, and your use of the Services does not create any professional relationship between you and Canopy Report.
  • You remain solely responsible for your own compliance with ISA/TRAQ standards, applicable professional and ethical obligations, and all laws and regulations governing your practice in your jurisdiction.

5. INFORMATION ABOUT YOUR CLIENTS

When you use the Services, you may submit information about your own clients and their property as part of a report's content, including client name, site address, tree location and GPS coordinates, and photographs. You represent that you have the necessary rights, consent, or client relationship required to submit this information, and you remain responsible for your own compliance with any privacy or confidentiality obligations you owe to your clients. 6. FEES AND PAYMENT

  • Report exports are charged a flat fee of $19 USD per export.
  • Your first export is free for the lifetime of your account.
  • Re-downloading a report you have already unlocked is always free.
  • There is no subscription — you are only charged when you choose to export a report.
  • Payments are processed by Stripe. By making a purchase, you also agree to Stripe's terms of service and privacy policy.
  • We may change our pricing at any time with reasonable notice. Any change will not affect exports you have already unlocked.

7. REFUNDS

We consider refund requests made within 7 days of purchase on a good-faith basis. To request a refund, contact us at admin@canopyreport.app or through https://canopyreport.app/contact. Approved refunds are processed as promptly as reasonably possible. We reserve the right to decline refund requests that appear abusive or made in bad faith.

8. ACCEPTABLE USE

You agree not to:

  • Create multiple accounts, provide false credential/license information, or otherwise attempt to circumvent the one-time free export or any other limitation of the Services;
  • Reverse engineer, decompile, scrape, or use automated means to access the Services without our written permission;
  • Upload or submit content that is unlawful, infringing, or that you do not have the right to submit;
  • Use the Services in any way that violates applicable law or your professional or ethical obligations; or
  • Interfere with or disrupt the integrity or performance of the Services.

We may suspend or terminate your account for violation of this section.

9. INTELLECTUAL PROPERTY

We own all right, title, and interest in the Services, including our software, matrices, templates, and branding, excluding any content you submit. As between you and us, you retain ownership of the report content you submit — including client information, field observations, and uploaded photographs — and of the reports generated for you. You grant us a limited license to host, store, and process this content solely to provide the Services to you. If you upload a firm logo or other branding assets, you represent that you have the necessary rights to use them, and you grant us a limited license to include them in your generated reports.

10. AI FEATURES

The Services include optional AI-assisted drafting of narrative report sections, provided through a third-party AI service (see our Privacy Policy for detail). This feature is a convenience only. AI-generated content is never authoritative and must be independently reviewed by you before use. We make no representation or warranty regarding the accuracy of AI-generated content, and you use it at your own discretion and risk.

11. DISCLAIMERS

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RISK RATING, CALCULATION, OR AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

THE SERVICES ARE A TOOL TO ASSIST QUALIFIED PROFESSIONALS IN PREPARING THEIR OWN WORK PRODUCT. WE DO NOT WARRANT, AND EXPRESSLY DISCLAIM ANY RESPONSIBILITY FOR, THE ACCURACY OR ADEQUACY OF ANY TREE RISK ASSESSMENT, CONCLUSION, OR RECOMMENDATION CONTAINED IN ANY REPORT GENERATED USING THE SERVICES.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CANOPY REPORT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM TREE FAILURE, FROM ANY PROFESSIONAL CONCLUSION OR RECOMMENDATION YOU MAKE, OR FROM ANY PARTY'S RELIANCE ON A REPORT GENERATED USING THE SERVICES. YOU, NOT CANOPY REPORT, ARE THE PROFESSIONAL RESPONSIBLE FOR THE ASSESSMENT AND ITS CONCLUSIONS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Canopy Report from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Services; (b) your professional conclusions, judgment, or recommendations; (c) your breach of these Terms; (d) your violation of any law or the rights of any third party; or (e) content you submit through the Services.

14. TERMINATION

You may delete your account at any time through your account settings. We may suspend or terminate your access to the Services at any time for violation of these Terms or the Acceptable Use section above. Sections of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification — will survive.

15. GOVERNING LAW

These Terms are governed by the laws of the Province of Nova Scotia and the laws of Canada applicable therein, without regard to conflict of law principles.

16. CHANGES TO THESE TERMS

We may update these Terms from time to time. The updated version will be indicated by a revised "Last updated" date at the top of this page. If we make material changes, we will provide reasonable notice, such as by posting a notice on the Services. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
